This Privacy Policy governs how ENSTEAD Company Limited (operating as YourCreditPal) collects, uses, shares, sells, and retains your personal information in connection with our loan referral and lead generation services. By using this Site or submitting any personal information through our platform, you acknowledge that you have read, understood, and agreed to this Privacy Policy and our Terms of Use. Your use of our services constitutes your acknowledgement of the collection, sale, and sharing of your personal information as described herein, including the tracking methods used to record your prior express written consent under the Telephone Consumer Protection Act (TCPA) for automated communications.

1. Important Information and Who We Are

About YourCreditPal

ENSTEAD Company Limited (operating as YourCreditPal, “we”, “us”, or “our”) operates as a loan referral and lead generation platform. Our primary business is to assist consumers in identifying and connecting with qualified third-party lenders and financial service providers (“Lending Partners”) within our network. By collecting personal and financial information voluntarily submitted by you through our platform at yourcreditpal.com, we facilitate a matching process that allows you to be connected with Lending Partners regarding loan products, credit offers, and related financial services.

YourCreditPal is not a lender. We do not make lending decisions, issue credit, determine eligibility for any loan product, or bear responsibility for any lending terms offered by Lending Partners. We provide digital infrastructure and lead generation services to connect your request for financial products with providers within our network.

1.1 Controller

We are the data controller responsible for your personal data collected through this website and our services. As controller, we determine the purposes and means of processing your personal data as described in this Privacy Policy.

1.2 Scope of This Privacy Policy

This Privacy Policy describes how we collect, use, share, sell, retain, and protect your personal data through your use of this site, our mobile application, any associated applications, and any other means by which you interact with us (collectively, “Services”). It applies to all personal data collected:

  • Directly from you when you use our website or submit a lead generation form;
  • Automatically through your use of our website and digital technologies;
  • From third-party data sources as described in this Policy;
  • Through offline interactions with us, including by telephone.

This website and our Services are not intended for children under the age of 18. We do not knowingly collect data from children.

1.3 Your Agreement

Please read this Privacy Policy carefully before using our Services. By using this site or submitting personal information through our lead generation forms, you acknowledge that you have read and understood these terms. Where you provide personal information, you will be asked to provide explicit consent to our collection, sale, sharing, and use of your information as described herein. If you do not agree with any part of this Privacy Policy or our Terms of Use, please refrain from using this site or our Services.

2. Definitions

As used in this Privacy Policy, the following terms are defined as follows:

  • Authorized Agent means a natural person or business entity that a Consumer has authorized to act on their behalf in exercising privacy rights.
  • Automated Dialing System or ATDS refers to equipment which has the capacity to store or produce telephone numbers to be called and to dial such numbers, as defined under the TCPA.
  • California Privacy Act means collectively the California Consumer Privacy Act of 2018 (CCPA) as amended by the California Privacy Rights Act of 2020 (CPRA) and associated regulations.
  • Consumer means a natural person who uses or interacts with our Services. Where state-specific rights are described in this Privacy Policy, those rights apply only to residents of the applicable state as defined by the relevant state law.
  • Consumer Request means a submission by a Consumer expressing interest in being matched with Lending Partners for loan products.
  • Contractor means a third party to whom YourCreditPal makes available personal data for a business purpose pursuant to a written contract.
  • Data Technologies means technologies such as cookies, pixels, web beacons, local shared objects, device identifiers, advertising identifiers, software development kits, JavaScript tags, session replay or consent-recording tools, and similar tracking technologies.
  • DPDPA means the Delaware Personal Data Privacy Act, effective January 1, 2025.
  • Lead means a Consumer’s personal and financial profile submitted through our platform for the purpose of connecting the Consumer with Lending Partners.
  • Lending Partners means third-party lenders, financial institutions, and financial service providers in our network to whom we sell or transfer Consumer Leads.
  • Personal Data or Personal Information means information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular Consumer, household, device, browser, session, cookie, pixel, advertising identifier, SDK identifier, online identifier, or other linkable identifier. Personal Data includes Sensitive Personal Data, Technical Data, and Usage Data to the extent such data is reasonably capable of being associated with or linked to a Consumer, household, device, browser, or session.
  • Sale means selling, renting, releasing, disclosing, disseminating, making available, transferring, or otherwise communicating orally, in writing, or by electronic or other means, a Consumer’s personal data to a third party for monetary or other valuable consideration.
  • Sensitive Personal Data includes social security or government ID numbers, financial account numbers combined with security codes, precise geolocation data, racial or ethnic origin, religious beliefs, genetic data, biometric data used to identify a Consumer, health information, and information about sexual orientation or sex life.
  • Service Provider means a third party that processes personal data on YourCreditPal's behalf pursuant to a written contract.
  • TCPA means the Telephone Consumer Protection Act of 1991, as amended and interpreted by the Federal Communications Commission.
  • Terms of Use means the terms and conditions governing your use of yourcreditpal.com.

3. Types of Personal Data We Collect

We may collect, use, store, and transfer different categories of personal data about you. The table below sets out the categories we collect, their nature and type, the purposes for collection, whether they are sold or shared, the categories of third parties to whom they are disclosed, and our retention periods.

We also collect, use, and share aggregated data such as statistical or demographic data that does not directly identify any individual Consumer. This is not personal data and may be used for analytics, business development, and improving our Services.

4. How Your Personal Data Is Collected

We use different methods to collect data from and about you, including through:

4.1 Your Direct Interactions With Us

You may give us your personal data by filling in online lead generation forms, corresponding with us by telephone, email, post, or otherwise. This includes personal data you provide when you:

  • Submit a Consumer Request (loan inquiry form) through our Site;
  • Create an account on our website;
  • Subscribe to our services or publications;
  • Request marketing to be sent to you;
  • Enter a competition, promotion, or survey;
  • Give us feedback or contact us through any channel.

4.2 Automated Technologies and Interactions

As you interact with our website, we automatically collect Technical Data about your equipment, browsing actions, and patterns using Data Technologies including cookies, pixels, web beacons, and similar technologies. We may also receive Technical Data if you visit other websites that employ our cookies or tracking technologies. Please see Section 15 (Cookies and Tracking Technologies) for further details.

We use TrustedForm, a third-party lead consent recording service, which captures and stores a record of your web session at the time you submit a Consumer Request, including your IP address, browser type, the date and time of submission, and the form environment you experienced. These records are maintained to evidence the consent you provide and for TCPA compliance purposes.

4.3 Third-Party and Publicly Available Sources

We may receive personal data about you from third parties and public sources, including:

  • Analytics providers such as Google Analytics;
  • Advertising networks and data brokers;
  • Search information providers;
  • Credit referencing and identity verification services;
  • Other lead generation companies that sell or transfer Consumer Requests to YourCreditPal where the Consumer's personal data was originally collected by that third party from the Consumer on the third party's website.

4.4 Trackable Telephone Numbers

We may publish uniquely generated, trackable telephone numbers on the site or in advertisements. If you call one of these numbers, we or a service provider working on our behalf may record the date, time, and duration of your call and the telephone number from which the call originated, for service quality and compliance purposes.

4.5 Combined or Appended Data

We may combine personal data obtained from third parties with personal data we have collected about you, including data about your use of our site and services, your interactions with Lending Partners, your interests and preferences, and other information. This combined data may be used for the purposes described in Section 5.

5. How We Use Your Personal Data

5.1 Legal Bases for Processing

The law requires us to have a legal basis for each purpose for which we process your personal data. We rely on one or more of the following:

  • Performance of a contract: Where processing is necessary to perform a contract with you or to take steps at your request before entering into one.
  • Consent: Where you have provided your active, informed, and freely given consent to the processing, including TCPA consent for automated communications.
  • Legitimate interests: Where processing is necessary for our legitimate business interests, provided those interests are not overridden by your rights and freedoms.
  • Legal obligation: Where processing is necessary to comply with a legal obligation to which we are subject.

5.2 Purposes for Which We Process Your Personal Data

5.3 Direct Marketing

You will receive marketing communications from us if you have requested information from us, submitted a Consumer Request, or otherwise consented to receive marketing. We may also analyze your Identity, Contact, Technical, Usage, and Profile Data to determine which products, services, and offers may interest you.

5.4 Third-Party Marketing

We will obtain your express consent before we share your personal data with any third party for their own direct marketing purposes (beyond the lead sale process described in Sections 6 and 7).

5.5 Opting Out of Marketing

You can ask us to stop sending you marketing communications at any time by following the opt-out links in any marketing email or SMS, by replying STOP to any text message, or by contacting us via the details in Section 20. Even if you opt out of marketing, you will continue to receive service-related communications that are essential for administrative or customer service purposes, including updates to our Terms of Use and this Privacy Policy.

7. Disclosures of Your Personal Data

We may share your personal data where necessary with the parties described below for the purposes set out in Section 5. We require all third parties to respect the security of your personal data and to treat it in accordance with applicable law.

7.1 Lending Partners & Lead Networks (Lead Sales)

Our primary disclosure of your personal data is the sale, matching, or transfer of your Lead profile to Lending Partners within our network when you submit an inquiry. By inserting a hyperlink to our partner network directly into the consent text, we ensure you have clear visibility into the entities receiving your profile. Each Lending Partner will act as an independent controller of your data, and their processing will be governed by their own privacy policies.

7.2 Lead Aggregators and Resellers

In some cases, we may sell Leads to other digital marketing and lead generation companies that subsequently transfer those Leads to their own clients (including lenders). When we do so, we disclose this practice to you at the time of collection and require contractual assurances that such resellers comply with applicable law, including TCPA consent requirements.

7.3 Service Providers and Contractors

We engage Service Providers and Contractors that process personal data on our behalf, including:

  • Lead verification and fraud prevention vendors;
  • IT infrastructure and data hosting providers;
  • Analytics providers;
  • Email and SMS communication platforms;
  • Customer relationship management systems;
  • Professional advisers including lawyers, auditors, and insurers.

We require all Service Providers and Contractors to only process personal data for specified, lawful purposes and in accordance with our instructions.

7.4 Professional Advisers

We may share personal data with lawyers, bankers, auditors, and insurers in the course of obtaining professional services.

7.5 Regulatory and Law Enforcement Bodies

We will disclose personal data to governmental agencies, regulators, courts, or law enforcement authorities as required by applicable law, rule, regulation, or legal order, including in response to subpoenas or lawful requests.

7.6 Business Transfers

Personal data is a business asset of YourCreditPal. In connection with any merger, acquisition, sale of assets, debt financing, restructuring, insolvency, or receivership, personal data may be transferred as part of the transaction. We will make reasonable efforts to ensure that any successor respects this Privacy Policy.

8. Sale and Sharing of Personal Data

YourCreditPal's core business model involves the sale and transfer of Consumer Leads, including personal and financial information, to Lending Partners and lead networks. By submitting a Consumer Request, you understand and agree that:

  • Your Lead profile, including your name, contact information, and financial data, will be sold to and used by the Lending Partners within our network;
  • Lending Partners may use your personal data for their own marketing, customer service, and lending purposes in accordance with their own privacy policies;
  • YourCreditPal may also sell Leads to lead aggregators and resellers who may further transfer your data to their lender clients;
  • You have the right to opt out of the sale of your personal data as described in Section 12 and, for California residents, in Section 17.

8.1 Opt-Out of Sale / Sharing

You may opt out of the sale or sharing of your personal data at any time by:

We will act upon opt-out requests within fifteen (15) business days of receipt. Please note that opting out of future sales does not affect Leads already transferred to Lending Partners prior to your opt-out, as those Lending Partners will have already received and may retain your data pursuant to their own privacy policies and our contractual arrangements.

9. International Transfers

We do not intentionally transfer your personal data outside of the United States. All personal data collected through yourcreditpal.com is stored and processed on secure servers located within the United States. If any processing does occur outside the US, we will ensure appropriate safeguards are in place in accordance with applicable law.

10. Data Security

We have implemented and maintain reasonable and appropriate administrative, technical, personnel, and physical security measures to protect your personal data against unauthorized access, destruction, use, modification, or disclosure. These measures include:

  • Encryption of personal and financial data in transit using TLS 1.2 or higher and at rest using AES-256 encryption;
  • Access controls limiting personal data access to authorized personnel with a legitimate business need;
  • Regular security testing and vulnerability assessments;
  • Employee training on data privacy and security obligations;
  • Third-party security audits and penetration testing conducted at least annually;
  • Incident response and data breach notification procedures.

Despite these measures, no method of electronic transmission or storage is 100% secure. While we strive to use commercially reasonable means to protect your personal data, we cannot guarantee absolute security or protection against every risk of unauthorized access, interception, or misuse.

10.1 Data Breach Notification

In the event of a data breach involving your personal data, we will notify you and any applicable regulatory authority as required by applicable law, including applicable state breach notification statutes. We have internal procedures for detecting, assessing, and reporting data security incidents.

11. Data Retention

We retain your personal data only for as long as is necessary to fulfil the purposes for which it was collected, including for the purposes of satisfying any legal, accounting, regulatory, or reporting requirements. The specific retention periods for each category of personal data are set out in the table in Section 3 and the table in Section 5.

As a general rule:

  • Consumer Request data (identity, contact, financial): 6 years from the date of submission or last use of Services;
  • TCPA consent records: minimum 5 years, as required for TCPA compliance and regulatory defense;
  • Technical and usage data: 3 years from collection;
  • Marketing preferences and opt-out records: 6 years, or until updated;
  • We may retain data beyond the above periods where required by applicable law, court order, or regulatory investigation.

When personal data is no longer required, it will be securely deleted or anonymized so that it can no longer be associated with you.

13. Children and Minors

yourcreditpal.com and our Services are not directed to, designed for, or intended for use by individuals under the age of 18 (Minors). We do not knowingly collect, process, sell, or share personal data from Minors. If you are under 18 years of age, do not use our website or Services or submit any personal information to us.

If we obtain actual knowledge that we have collected personal data from a Minor, we will promptly delete that information. If you believe we may have inadvertently collected personal data from a Minor, please contact our Privacy Team at contact@yourcreditpal.com.

In accordance with the Children's Online Privacy Protection Act (COPPA), we do not knowingly collect personal information from children under the age of 13.

15. Cookies and Tracking Technologies

15.1 What Are Data Technologies?

We use Data Technologies including cookies, local shared objects (flash cookies), pixel tags, web beacons, device identifiers, JavaScript tags, and similar technologies to collect information about your use of yourcreditpal.com and to enable certain features and functionality. These technologies may be placed by us or by third parties we authorize.

15.2 Types of Data Technologies We Use

  • Strictly Necessary Cookies: Essential for the operation of our website, including security and form submission functions. These cannot be disabled.
  • Analytics Cookies: Used to collect information about how visitors use our website (e.g., Google Analytics). This data is used in aggregate form to improve our Services.
  • Advertising and Targeting Cookies: Used to deliver interest-based advertising and to measure the effectiveness of advertising campaigns. These may be set by us or by third-party advertising networks.
  • Lead Consent Recording Technologies: We use TrustedForm by ActiveProspect to capture your web session at the time of Consumer Request submission to evidence your consent. This technology collects your IP address, browser type, date and time of submission, and the form environment you experienced.
  • Meta Pixel / Social Media Pixels: JavaScript code that tracks user activity on our website to measure the effectiveness of advertising on social media platforms. See below for opt-out instructions.

15.3 Your Cookie Choices

Most web browsers automatically accept cookies. You can modify your browser settings to decline cookies; however, certain features of the site may not function properly if you do so. You may also:

  • Opt out of interest-based advertising by multiple companies at www.aboutads.info/choices
  • Install the Google Analytics Opt-out Browser Add-on from tools.google.com/dlpage/gaoptout;
  • Adjust advertising identifier settings on your mobile device through your device's settings menu;
  • Opt out of Meta Pixel tracking through the Settings & Privacy menu on your Facebook/Meta profile;
  • Clearing your Activity Log;
  • Turning off location tracking;
  • Use browser privacy extensions to block tracking technologies.

15.4 Do Not Track and Global Privacy Control Signals

As of the effective date of this Privacy Policy, there is no universally accepted standard for responding to browser Do Not Track (DNT) signals. We do not currently respond to DNT signals. However, we do recognize and honor Global Privacy Control (GPC) opt-out preference signals. If we detect a GPC signal from your browser, we will treat it as a valid request to opt out of the sale and sharing of your personal data, as required by the California Privacy Act and other applicable state privacy laws. You may also exercise your privacy rights using the methods described in Section 12.

16. Changes to This Privacy Policy

We reserve the right to update or change this Privacy Policy at any time. Any changes will be posted on the site with the last updated date. We recommend that you review this Privacy Policy periodically. Your continued use of yourcreditpal.com and our Services following the posting of changes will constitute your acceptance of those changes.

Where a change to this Privacy Policy materially affects your rights with respect to your personal data, the change will not take effect until thirty (30) days after notice of the change is posted, during which time you may notify us that you do not accept the change. If you do not accept such a change, you must immediately discontinue use of our Services. If we make material changes that affect personal data already collected from you, we will make reasonable efforts to notify you and provide an opportunity to opt out.

17. California Residents

This section supplements this Privacy Policy and applies solely to eligible residents of California. It is provided in compliance with the California Consumer Privacy Act of 2018 (CCPA) as amended by the California Privacy Rights Act of 2020 (CPRA) and associated regulations (collectively, the “California Privacy Act”). Any capitalized terms not defined in this section have the meanings given in Section 2.

17.1 Summary of California Privacy Rights

a. Right to Know

California residents have the right to request that we disclose information about our collection, use, sale, sharing, and disclosure of their personal information over the past 12 months, including the categories of personal information collected; the categories of sources; the business or commercial purposes for collection; the categories of third parties to whom personal information is disclosed; and the specific pieces of personal information collected. We may be required to provide this information for periods beyond 12 months for personal information collected on or after January 2, 2022.

b. Right to Delete

California residents have the right to request that we delete their personal information, subject to certain exceptions under the California Privacy Act.

c. Right to Correct

California residents have the right to request correction of inaccurate personal information we maintain about them, and we will use commercially reasonable efforts to correct such information.

d. Right to Opt Out of Sale / Sharing

California residents have the right to direct us not to sell or share their personal information to third parties. YourCreditPal sells and shares Consumer Leads. California residents may exercise this right by:

California residents have the right to direct us to limit the use and disclosure of their Sensitive Personal Information to purposes necessary to perform the services reasonably expected by an average consumer, except as otherwise permitted by the California Privacy Act.

f. No Discrimination

We will not discriminate against California residents for exercising their rights under the California Privacy Act. We will not deny goods or services, charge different prices, provide different quality levels, or retaliate against employees or contractors for exercising these rights.

g. Right to File a Complaint

17.3 California Shine the Light Law

California residents may request information about whether we have disclosed personal information to third parties for direct marketing purposes in the immediately preceding calendar year. To submit such a request, contact our Privacy Team as provided above.

17.4 California Minors

YourCreditPal and all associated services are strictly intended for individuals who are at least 18 years of age. We do not knowingly market to, solicit, or permit registrations from individuals under the age of 18. However, if you are a California resident under the age of 18 and have registered an account on our site, California law permits you to request the removal of content or information you may have submitted or posted to our platform. Contact our Privacy Team to make such a request, noting that complete removal cannot always be guaranteed.

17.5 Annual Privacy Rights Metrics

As required by the California Privacy Act, YourCreditPal will publish annual metrics regarding the number of requests to know, requests to delete, requests to correct, and requests to opt out of sale received in the prior calendar year, as well as the median number of days within which YourCreditPal substantively responded to each type of request. These metrics will be published on yourcreditpal.com and updated annually.

18. Delaware Residents

This section supplements this Privacy Policy and applies to eligible residents of Delaware pursuant to the Delaware Personal Data Privacy Act (DPDPA), effective January 1, 2025.

18.1 Your Delaware Privacy Rights

Delaware residents have the following rights with respect to their personal data:

  • Right to Access: To confirm whether we are processing your personal data and to access that personal data.
  • Right to correct inaccuracies in your personal data.
  • Right to delete personal data you have provided to us or obtained about you.
  • Right to obtain a copy of your personal data in a portable, readily usable format.

We will acknowledge receipt of your request within ten (10) business days and respond substantively within forty-five (45) days, with a possible extension where reasonably necessary, which would be duly communicated.

18.3 Sensitive Data

Under the DPDPA, we will not process sensitive personal data without your prior consent. If we intend to collect sensitive data in connection with our Services, we will present you with a clear and prominent consent notice at the time of collection.

18.4 Right to File a Complaint

If we deny your appeal of a privacy rights request, we will inform you of your right to contact the Delaware Department of Justice to submit a complaint. Delaware residents may file a complaint with the Delaware Attorney General by emailing privacy@delaware.gov or by visiting https://attorneygeneral.delaware.gov.

19. Residents of Other US States

In addition to the state-specific provisions set out in Sections 17 and 18, residents of other US states that have enacted comprehensive consumer privacy legislation (including, without limitation, Virginia, Colorado, Connecticut, Utah, Montana, Oregon, Texas, Indiana, Iowa, New Jersey, and Tennessee) may have similar rights with respect to their personal data, including rights to access, correct, delete, and obtain a portable copy of their personal data, and to opt out of the sale of personal data, targeted advertising, and certain profiling activities.
